Why Environmental Due Diligence Is Non-Negotiable

Numbers from MECP, ECCC, CSA, and provincial regulators: the authorities that govern environmental requirements for energy and construction projects in Canada.

~35,000
Contaminated sites on provincial registries across Canada: any property transaction or change of use may trigger mandatory ESA requirements
MECP Brownfield Registry; CCME 2023
$10M+
Average remediation cost for complex brownfield sites in Ontario: environmental liability discovered after closing transfers to the new owner
Ontario Brownfield Stakeholder Report 2023
$6M
Maximum corporate fine under Ontario EPA for environmental non-compliance: plus personal liability for directors and officers
Ontario EPA s.186; Environmental Penalties O.Reg. 222/07
100%
Of solar farm, substation, and wind projects over 10 MW require environmental screening under the Ontario Environmental Assessment Act
Ontario EAA; O.Reg. 116/01
Environmental Requirements by Project Type
Phase I ESA
Required by every commercial lender for property transactions. Standard due diligence for solar farm financing, BESS siting, and substation development. 3-4 week turnaround.
CSA Z768-01 (R2022); CMHC, BDC, major bank requirements
GHG Reporting
Mandatory for facilities emitting 10,000+ tCO2e (federal) or 25,000+ tCO2e (Ontario). Increasingly required for ESG disclosures, green bond issuance, and carbon credit programs.
ECCC GHGRP; O.Reg. 390/18; GHG Protocol
ECA / Permit
Environmental Compliance Approvals required for air emissions, noise, stormwater discharge, and waste management at industrial and energy facilities. Non-compliance triggers stop-work orders.
Ontario EPA Part II.1; O.Reg. 419/05 (air); O.Reg. 560/94 (noise)

How Environmental Assessments Sequence with Your Project

Environmental work typically follows a defined sequence. RHEM coordinates each step alongside your engineering schedule so environmental requirements don't become schedule bottlenecks.

Phase I ESA
3-4 weeks
Phase II ESA
4-8 weeks (if needed)
Risk Assessment
6-12 weeks (if needed)
RSC Filing / Clearance
4-6 weeks

Dashed borders indicate steps that are only required if the previous step identifies concerns. Not every project requires the full pathway.
